James, who increasingly struggled to find words as the interview progressed, appeared backed into a corner when challenged by anchor Brianna Keilar about how Dominican national Miguel Francisco Mora Nunez was able to walk freely in New York City before shooting a border agent in the face — especially after he had already been deported once.
Keilar cited the distinction many voters show, reflected in polls, between undocumented migrants and criminal illegals, over which group should be prioritized for deportation.
“Why should those voters think that this is something other than the system not working?” she asked the state’s top cop while suggesting that better “coordination” with federal authorities may have led to Nunez’s arrest earlier.
James first tried to pivot her way out of answering.
“At the outset, I indicated to you that, in fact, New York state and other Democratic states cooperate with ICE when it comes to criminal convictions. But when it comes to innocent individuals — individuals who serve as your nanny, clean your home, individuals who are our neighbors, individuals who just unfortunately are trying to make ends meet,” she said before Keilar cut her off.
“But both of these individuals have multiple arrests after lawful deportation orders. Why are those not opportunities?” she asked as James tried to rebut.
“And that is why the state of New York when it comes to individuals, as you indicated, individuals with criminal convictions…” she paused. “Then we cooperate with ICE. But it’s important that we make a distinction” before repeating her earlier answer.
“The people who are being kidnapped are facing civil deportation,” she stated. “Innocent people are being caught up in these ICE raids.”
She then pivoted to take a shot at ICE for “agents, without any insignia, without any identification, kidnapping innocent individuals.”

She said that the attack appeared to be random and not directed at the agent for his role, NBC News reported.
Nunez, 21, was also hospitalized with a gunshot wound authorities believed was sustained during the incident.
New York Mayor Eric Adams revealed Sunday that he had visited with the Border Patrol agent and expressed outrage at state officials for failing to notify ICE about his presence in the city.
“In less than one year, he has inflicted violence in our city. And once he is charged for last night’s crimes, we will be able to add attempted murder to his rap sheet,” he said at a press conference.
