Oakland homeowner ARRESTED after he shot and killed burglar

A man in Oakland has been arrested on the suspicion of murder after he shot and killed a burglar who broke into his home.

The man he shot was one of three participating in the break-in, two men and a woman.

A 77-year-old Oakland man has been arrested after he shot and killed a suspected burglar.

Police say two men and a woman pulled up outside the man’s home in a stolen vehicle on Monday evening.

One suspect was allegedly holding a crowbar as the three headed inside the man’s home, as reported by KTVU.

The homeowner, who has not been publicly named, apparently shot one of the men, the woman in the group told officials.

He was pointing the gun at the woman when police arrived, per officials.

The third suspect was found at the scene with a replica gun and was arrested on suspicion of burglary.

The homeowner has been detained on suspicion of murder while the Alameda County District Attorney’s Office considers whether to file charges.

Police say the weapon used by the homeowner, a Colt Python revolver, was stolen.

Prosecutors have until Thursday to decide whether they will charge the homeowner, who has reportedly declined speaking with detectives.

KTVU adds some crucial witness testimony:

A witness told KTVU that he saw three people pull up to a home in a white Infiniti, which can be seen on video. Then a man in the car was said to have hopped the homeowner’s gate. That’s when the witness said he heard two gunshots ring out.

He said he called police and moments later, he saw the suspect stumbling from the same home and falling to the ground. The homeowner also emerged from the home and was armed.

Then, according to the witness, one of the other suspects in the Infiniti apparently took off on foot. Police arrived a short while later.

If the suspect was actually in the home when he was shot, then this case is open and shut and the homeowner should never have been arrested. Of course this is Oakland where lawlessness is allowed to reign and consequences are minimal, so of course they would arrest the homeowner on the suspicion of murder because he’s likely the only one innocent in this scenario.
