Biden issues new border executive orders, but Bill Melugin explains why it does NOT ‘shut down’ the border

Joe Biden has issued new executive orders for the southern border that are designed to ‘shut down’ the border when encounters exceed an average of 2,500 for seven days.

The Biden administration issued a set of executive actions that would temporarily suspend entry for noncitizens if the southern border sees a certain number of illegal crossers in a seven-day period.

“These actions will be in effect when the southern border is overwhelmed, and they will make it easier for immigration officers to quickly remove individuals who do not have a legal basis to remain in the United States,” the White House said in a press release.

If the average number of border encounters exceeds 2,500 in a seven-day period, entry to noncitizens would be suspended until 14 days after a seven-day average of 1,500 border encounters.

According to Fox News, in the 24 hours before the White House’s declaration, the border saw 5,200 encounters and has averaged 5,000 per day for a week.

Per U.S. Customs and Border Protection data, the 30-day average from April 2024 was 5,990 encounters per day.

Under Biden’s new rules, if the border saw 2,499 daily encounters (right below the threshold), without any suspensions, that would total over 912,000 encounters in a year. That number, while significantly lower than any figure achieved by the Biden administration, would still be higher than any year under President Trump.

The Biden order does not apply to visa holders, unaccompanied children, those with a medical emergency or imminent threat to their life, or victims of a “severe form” of trafficking. It also does not apply to those who use the CBP One app, which is used by about 1,500 people per day.

Fox News reporter and expert on the border, Bill Melugin, explains why these executive orders won’t actually shut down the border:

In no way can Biden’s executive order be described as “shutting down” the border.

It bans asylum to some illegal crossers, with some exceptions.

It does *not* stop or slow the up to 1,500 migrants per day released into the U.S. via CBP One app at ports of entry, and does not stop or slow the up to 30,000 migrants per month flying directly into the U.S. and being released into the country via Biden’s controversial mass parole program for Cubans, Haitians, Nicaraguans, and Venezuelans.

Unaccompanied children/minors are exempt from the order – which will lead to concerns about child trafficking, and migrants can still claim fear in an attempt to avoid deportation.

Also, asylum has already been banned for most migrants who cross illegally since the end of Title 42 last year – and that hasn’t stopped them from coming. Highest numbers in recorded history end of 2023.

The order may speed up removals to countries we can deport easily to, (Mexico, northern triangle countries, etc), but there has been no explanation as to how the administration will be able to begin mass removals of migrants coming from another hemisphere with governments that don’t cooperate with the U.S.

Between the 2,499 allowed per day, the 1,500 illegals released via the CBP One app and the 30,000 flying into the country on Biden airlines, we’re still talking close to 2 million illegals allowed into the country every year. That’s absolutely horrible.

Biden just wants something he can tout on the campaign trail regarding his reckless and chaotic open border. This is nothing more than an empty gesture to help him get elected while doing nothing to really shut down the border.
