Biden Takes a Page Right Out of Trump’s Policy Playbook as Title 42 Comes to an End

 

President Joe Biden is reinstating a policy from his predecessor’s playbook as the pending termination of Title 42 threatens to plunge the southern border into chaos.

The federal government has finalized a new regulation that will bar migrants from applying for asylum in the United States if they’ve arrived from a safe third country without applying for asylum there, according to CBS News.

If enforced, the regulation could prevent many illegal immigrants from filing an asylum claim in the United States after crossing the U.S. — Mexico border.

Those who do not qualify for a lengthy proceeding in the nation’s byzantine immigration court system could then be quickly deported.

In this respect, the policy would serve as a replacement to Title 42 — a pandemic-era Trump administration policy that allowed quick deportations of illegals on public health grounds.

Title 42 is slated to expire on Thursday, according to Fox News.

The new regulation closely resembles another policy made by former President Donald Trump.

A rule barring asylum claims from migrants who declined to file them in an alternate country was overthrown in federal court in 2020, according to CBS.

Trump also enacted a “Remain in Mexico” policy that required migrants to await the adjudication of their American asylum claims in Mexico.

This policy proved effective in deterring large “caravans” of illegal aliens from traveling to the border.

Biden ultimately ended enforcement of the Remain in Mexico policy in 2022, with legal disputes ongoing in the federal courts.

The Department of Homeland Security has pledged tougher enforcement of U.S. immigration laws as Title 42 nears its termination.

However, large groups of illegal migrants arriving at the border in advance of the policy’s end don’t seem to have gotten the message — or taken it seriously.

Border Patrol reported apprehending an average of 8,794 illegals every day over the weekend — a figure that Fox News border reporter Bill Melugin called the highest daily count he’d ever seen the agency disclose.

The Biden administration has ordered DHS to release some migrants into American communities without a court date or any means to track them, according to NBC News.

Biden Surrenders to Invasion: Feds Will Release Illegal Aliens With No Court Date or Ability to Track Them


The Biden administration is formulating a memo for Customs and Border Protection (CBP) directing them to release illegal immigrants into the United States with no court dates or ability to track them.

The news comes as Title 42, the Trump-era pandemic public health restrictions that became a key tool in turning back illegal aliens at the border, is set to expire Thursday.

NBC News reports that multiple sources have indicated the White House will direct CBP to deal with the surge by simply releasing individuals with no means to track them.

The network notes that a similar plan was implemented in 2021, but those involved were required to participate in a program directing them to check in on a mobile app until they were provided a court date.

“The new policy would release them on ‘parole’ with a notice to report to an Immigration and Customs Enforcement office but without enrolling them in the program,” NBC homeland security correspondent Julia Ainsley writes.

Biden to Release Illegal Immigrants With No Court Date or Plan to Track Them

News of the Biden administration releasing illegal immigrants into the United States with no court date or means to track them comes as early numbers indicate the Title 42 rollback will be even more devastating than predicted.

A total of 11,000 illegal immigrants were apprehended at the border on Tuesday. That number represents a record and exceeds expectations as predicted by Department of Homeland Security officials when the pandemic-era restrictions are lifted.

Homeland Security Secretary Alejandro Mayorkas all but admitted to the memo allowing illegal aliens to cross through with no court date or plan to track them.

Mayorkas insisted there are still conditions involved that the illegal aliens will have to meet.

“Like other administrations, when we release individuals, we release them on conditions — and their compliance with those conditions is absolutely necessary,” he told reporters Wednesday. “And if they fail to comply, we will seek to apprehend them and remove them.”

It is unclear how authorities are supposed to apprehend them if they aren’t being tracked or given a court date.

Surrendering to the Invasion

The Center Square’s Bethany Blankley has been warning of the Biden administration’s expansion of illegal immigration recently, a waving of the white flag as the mass invasion begins post-Title 42.

New DHS policies, she reported last week, will “significantly expand lawful pathways for protection, and facilitate the safe, orderly, and humane processing of migrants.”

On Wednesday, Blankley noted that the administration is “implementing a plan decided on last year to release them en masse into local border communities.”

‘En masse’ with no means to track them. If the 11,000 apprehensions on Tuesday are any indication, extrapolated numbers would mean over 4 million illegal aliens could cross the border in a single year. If that number grows as Title 42 is rolled back, the numbers would be eye-watering.

Despite all the evidence to the contrary, Mayorkas continued to insist the border is closed.

“Our border is not open,” he declared. “Do not risk your life and your life savings only to be removed from the United States if — if and when — you arrive here.”

But *wink wink* you won’t really be removed, you won’t have to go to court, and we won’t be tracking you *wink wink*.

“We are a nation of immigrants. We are also a nation of laws,” Mayorkas said.

We were … until Biden and Mayorkas took over.

Releasing illegal immigrants with no court date or ability to track them will only make the crisis worse and will aid and abet cartels and human traffickers.

Mayorkas last week insisted the administration has a “plan” to combat the border surge as Title 42 comes to an end. That plan was clearly to swing the doors wide open.

Border Patrol agents apprehended more than 10,000 illegal immigrants per day on May 8 and May 9—the highest daily totals on record—as law enforcement and border agents prepared for the expiration of Title 42 on May 11.

Migrants have been flocking to the southern border in recent weeks as the policy neared expiration. Drone footage captured on May 8 by Fox Flight Team showed long lines of migrants camping out just across the U.S. border near El Paso and Brownsville, Texas.

“Texas is already being overrun with illegal aliens ahead of Title 42’s expiration. The Lone Star State—and the rest of the country—will pay dearly for Biden’s open border policy decision,” Sen. Ted Cruz (R-Texas) wrote on Twitter on May 10.

With the expiration of the public health policy, migrants will be processed under Title 8 immigration law, which is a lengthy procedure allowing illegal immigrants to seek asylum.

Title 42’s health policy allowed officials to quickly expel migrants who entered the United States illegally. Unaccompanied children were exempt from the policy. Since March 2020, the policy has been used more than 2.8 million times to expel migrants.

In addition to the 2,500 National Guard troops already positioned across the southern border, the Biden administration said it would send another 1,500 troops for the expected surge of border crossings.

“These personnel will be performing administrative tasks, like data entry, and warehouse support,” White House Press Secretary Karine Jean-Pierre said during a press briefing on May 2.

“They will not be performing law enforcement functions or interacting with immigrants or migrants. This will free up border agents to perform their critical law enforcement duties,” she said.

The troops will be deployed for 90 days, according to the White House.

Video captured by journalist Todd Bensman on May 10 showed DPS troopers and Texas National Guard soldiers physically blocking migrants trying to cross into Texas as razor wire was being placed along border hot spots.

“Great work by Texas National Guard and Texas DPS,” Texas Gov. Greg Abbott Abbott wrote in a Twitter post sharing the video. “Biden sent 1,500 troops to the border to do paperwork. Texas deployed trained soldiers and troopers to take real action and respond to this crisis.”

Texas Tactical Border Force Deployed

Abbott announced the deployment of the new Texas Tactical Border Force just ahead of the expiration of the health policy that turned back millions of illegal immigrants over the last three years.

“The Texas National Guard is loading Blackhawk helicopters and C-130s and deploying specially trained soldiers for the Texas Tactical Border Force, who will be deployed to hotspots all along the border to help intercept and repel large groups of migrants trying to enter Texas illegally,” Abbott said in a press release on May 8.

The Texas Department of Public Safety (DPS) has also deployed additional support to the border.

“The Texas Department of Public Safety is increasing resources at the border, and we are deploying hundreds of troopers around the state, including enhanced tactical teams and field force operations teams, to hold the line,” DPS Director Steve McCraw said in a statement.

Texas and Mexico share 1,254 miles of common border with more than two dozen legal ports of entry where migrants can apply for lawful admission into the United States.

“There are 29 places you can cross into the U.S. legally, and our job is to ensure we hold that line and keep those the only places these people can cross,” McCraw continued.

The Department of Homeland Security (DHS) has estimated that border agents could encounter as many as 13,000 migrants per day following Title 42’s expiration.

DHS Secretary Blames Congress

DHS Secretary Alejandro Mayorkas on May 10 blamed the Republican-majority Congress for the crisis at the border, warning that the next few weeks would be “difficult” as the policy comes to an end.

“Our current situation is the outcome of Congress leaving a broken, outdated immigration system in place for over two decades, despite the agreement that we desperately need legislative reforms,” Mayorkas said.

“It is also the result of Congress’s decision not to provide us with the resources we need and that we requested.”

In late March, 11 Republican House members co-signed a letter to House Appropriations Committee Chair Kay Granger (R-Texas) and House Appropriations Subcommittee on Homeland Security Dave Royce (R-Ohio) that Mayorkas’ paycheck be withheld over his alleged failure to stem the border crisis, The Epoch Times reported.

Mayorkas maintains the border is secure.

“Lifting of the Title 42 public health order does not mean our border is open,” he said, adding that the use of immigration enforcement under Title 8 “means tougher consequences for people who crossed the border illegally.”

“Unlike under Title 42, an individual who is removed under Title 8 is subject to at least a five-year ban on re-entry into the United States and can face prosecution if they attempt to cross again,” he continued. “Smugglers have long been hard at work spreading false information that the border will be open after May 11.”

Deportations and Reentries

Thousands of illegal immigrants are expelled annually under Title 8 for criminal convictions, drug possession, drug trafficking, human trafficking, and other factors that make them inadmissible to the United States.

In fiscal year (FY) 2022, Customs and Border Protection (CBP) arrested 12,028 illegal immigrants with criminal convictions, up from 10,763 the prior ear. The fiscal year runs from Oct. 1 through Sept. 30.

So far, for FY 2023, more than 5,100 have been arrested for prior convictions. Thousands of those arrested for removal have been deported multiple times.

ICE Enforcement and Removal Operations apprehended nearly 44,000 “noncitizens” with criminal histories during FY 2022. This group had a total of 198,498 charges and convictions, according to the ICE Fiscal Year Annual Report (pdf).

Reentering the country after expulsion is an “aggravated felony” under immigration law and brings severe penalties.

Still, many illegal immigrants who have been expelled reenter the country despite the law.

In late April, an illegal immigrant allegedly shot and killed five of his neighbors—including a 9-year-old boy—in Cleveland, Texas. He was arrested after a four-day manhunt.

The suspect, Francisco Oropesa, 38, a Mexican national, had been in the country illegally for years and had been deported at least four times before the shooting, most recently in 2016, a spokesperson for ICE told The Epoch Times.

He was taken into custody on May 2. He is charged with 5 counts of first-degree murder and is being held in the San Jacinto County jail on a $7.5 million bond—$1.5 million for each of the victims.

Governor DeSantis Signs Nation’s Toughest Illegal Immigration Bill, Attacks Biden Border Policy

In Florida, Gov. Ron DeSantis on May 10 signed an illegal immigration bill he said was the toughest in the country.

One of its provisions requires companies with more than 25 employees to use the federal E-Verify system to check a job applicant’s eligibility.

At a signing ceremony in Jacksonville, DeSantis blasted the Biden administration’s lack of border enforcement, allowing illegal immigration to surge.

DeSantis said that with the formal ending of the COVID crisis—and the expiration of immigration controls tied to it—illegal immigrants would enter the country at a rate of over 13,000 a day, more than 4.5 million a year.

He tied that to many problems: crime, record rates of drug overdose deaths, and a skyrocketing financial burden to taxpayers forced to fund services such as medical care, education, and law enforcement for illegals.

“Alexander Hamilton wrote in the Federalist Papers that energy in the executive is the leading characteristic of good government,” DeSantis said.

“Where’s this president’s energy? Where’s his vigor? Where’s his commitment to the cause? He’s just sitting around doing nothing of importance or nothing of note while the American people suffer.”

That suffering was attested to by two speakers at the event.

One, Rep. Kiyan Michael, a Republican representing Jacksonville in the state House, lost her son in a fatal auto collision with an illegal immigrant who was at fault in 2007.

The other, Nikki Jones, lost her husband in a fatal auto accident in 2019 with a drunk illegal immigrant who had previous DUI arrests but had never been deported.

Cracking Down on Employers

She is now struggling to raise two toddlers, who were 2 years and 6 months old, when their father died.

Other provisions of the bill include suspending licenses for employers who knowingly employ illegal immigrants; making use of a fake ID to gain employment a felony; banning local governments and non-governmental organizations from issuing identification documents to illegal migrants, and invalidating out-of-state driver’s licenses issued exclusively to illegal border crossers.

The bill enhances penalties for human smuggling. It makes knowingly transporting five or more illegal migrants or a single illegal minor a second-degree felony subject to a $10,000 fine and up to 15 years in prison.

It provides $12 million to continue the Unauthorized Alien Transport Program to relocate illegal immigrants to sanctuary jurisdictions.

DeSantis made headlines last year when he sent 50 illegal immigrants to the upscale Massachusetts vacation island of Martha’s Vineyard, a sanctuary city.

And the bill requires hospitals to collect and report health care costs for illegal border crossers. During the 2021-22 fiscal year, DeSantis said, they ran up $340 million in health care costs. “Taxpayers were on the hook for two-thirds of that,” he said.

The Biden administration wants to use Medicaid to cover illegal aliens, said DeSantis, adding that Florida doesn’t support it and won’t do it. He said gathering data about the care given to those here illegally will help.

“Because [while] we were able to identify some, we think that there’s a lot more and the public deserves an honest accounting of how much this is costing us in terms of services. And healthcare is probably No. 1.”

DeSantis pounded Biden repeatedly.

He said the president wouldn’t give the Coast Guard enough assets to adequately patrol off Florida’s shores to stop illegals at sea who can be sent back.

Presidential ‘Dereliction of Duty’

The governor said the president is guilty of a “huge dereliction of duty” in permitting a border so open that the nation had over 100,000 overdose deaths last year.

“The Biden administration recently claimed that when it comes to illegal immigration, quote, you’ve seen it come down by more than 90 percent,” he said.

“That is a lie. That is something that they’re trying to feed you and hope their buddies in corporate media will run with it, but that is factually untrue and demonstrably untrue.”

A provision of the new bill is the use of rapid DNA technology, which allows DNA analysis and matching in as little as 90 minutes, said Al Nienhuis, Hernando County Sheriff and president of the Florida Sheriff’s Association.

It has previously taken up to 3 months to get a DNA match, and people were only tested if arrested for serious crimes, he said.

Now, he said, all illegal immigrants will be tested, even when picked up for minor crimes like shoplifting. That will allow authorities to determine quickly—before the detainee can be released on bail—if the suspect is wanted elsewhere in the country on more severe charges.

Nienhuis discussed serious crimes committed by illegal immigrants and exemplified the system’s breakdown. A man recently sentenced to 60 years in prison for murder had been caught in Texas by the Border Patrol, claimed to be a juvenile, gave a false name to law enforcement, and was released with a notice to appear in court.

He was released in Jacksonville “in the dead of night, without any notice to local law enforcement, where he was released without any supervision whatsoever.”

Devastating Testimony

Only after he stabbed a local resident to death did he come to the system’s attention, Nienhuis said.

In another case, Nienhuis said a 19-year veteran of the Pinellas County Sheriff’s Office was struck and killed by an illegal immigrant employed by a construction company.

“This murderer made his way across the southern border without incident and made his way to Tampa, where he was hired along with several other immigrants.”

Jones, a Plant City widow, said her husband’s killer “had multiple traffic violations including DUIs and kept getting let out on U.S. soil prior to him killing my husband. Yeah, four violations and he never got deported. He even attended DUI school as an illegal alien in the state of Florida.”

The man knew how to manipulate the system, she said, and refused a breathalyzer and field sobriety tests.

“Despite evidence of alcohol in the scene, there was a lack of evidence for the court system, which resulted in a lesser charge,” she said. “Ultimately, he was sentenced to four years in jail with plans of deportation. Currently, he is at an ICE detention facility after serving only three years.”

“The aftermath is devastating beyond words,” she said. “I have two girls. One was only six months and the other only two years at the time he was killed. They will never know their father or know how much he loved them.

“They will never experience father-daughter dances or go fishing with him, which my husband loved to do, and always talked about teaching the kids how to fish when they got older.”

“Every day I wake up and pray to god that I will be able to keep my home for my kids. We had just bought our home. My husband just retired from the military and we settled in Plant City, Florida.”

Governor’s Words of Comfort

She’s had to face the challenge of paying a mortgage, childcare, and other bills without her husband’s support or any other help.

“Nobody holds responsibility for illegal aliens in the United States. So when an American or legal family is destroyed, there are no funds to stabilize that family. No businesses are held accountable. No sponsors are held responsible. No relief programs are available. Nothing. I’ve tried.”

DeSantis, who opponents have sometimes criticized for lack of warmth, showed his human side at this press conference.

When Jones finished speaking and he returned to the podium to thank her, the mike picked up his quiet words, comforting her and telling her that help might be available.

He thanked her daughters, who were in the audience, at the end of the speech for being so good and handed them two pens he used to sign the bill.

Michael said she was grateful for the opportunity to sponsor the bill in the House, despite being a freshman legislator just elected in November 2022.

She said that her son was driving to cash his paycheck when the fatal accident occurred. Her son’s killer was “a twice-deported illegal. That means he was deported twice and defied our laws, and came back.”

She said he didn’t have a driver’s license and didn’t know he couldn’t make a U-turn at the intersection where he plowed into the car driven by Michael’s son.

“He didn’t know our laws and couldn’t understand our signs,” she said.

Money spent on illegal immigrants disturbs her, she said.

“We have senior citizens that cannot afford to pay their bills. They have to decide, are they going to be able to eat? It bothers me that we have veterans like my husband, 20 years in the military, and they’re sleeping on the street, when we have illegals in hotels. That bothers me.”

DeSantis spoke for more than 20 minutes, frequently with passion. In thanking him for his support on the issue, Nienhuis said.

“He’s not only courageous, but does he have a tremendous grasp of minute details over such a broad spectrum. I see people nodding their heads. I thank you for taking the time to really educate yourself on these issues.”
